Erebus LLC "(Erebus" or “we” or “us” or “our”) has created this Privacy Policy to demonstrate our commitment to user and visitor privacy. By visiting the Apocalypsenow.com site or using our services (“Services”), you are agreeing to the collection and use of information in the manner described below.

As further described below, Erebus complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States.

The Apocalypsenow.com site and our Services are not directed at children under 13 years of age, nor do we knowingly collect information from children under13 years of age. if your child under 13 has accessed the Apocalypsenow.com site or our Services, please so inform us immediately so that we may remove any personally identifiable information they may have provided.

What We Collect

In order for you to create an account on Apocalypsenow.com and use our Services, we need to collect and process some information. Depending on your use of the Services, that may include:

  • information (such as your name, email and postal addresses, telephone number, and country of residence) that you provide by completing forms on Apocalypsenow.com, including if you register as a user of the Services, subscribe to our newsletters, upload or submit any material through Apocalypsenow.com, or request any information;
  • your login and password details, in connection with the account sign-in process;
  • details of any requests or transactions you make through the Services;
  • information about your activity on and interaction with Apocalypsenow.com, such as your IP address and the type of device or browser you use;
  • information necessary to deliver Rewards to you, such as your t-shirt size and color preferences
  • communications you send to us (for example, when you ask for support, send us questions or comments, or report a problem); and
  • information that you submit to Apocalypsenow.com in the form of comments, contributions to discussions, or messages to other users.

In order for you to back the Game, you must select a Pledge Tier and provide payment information, such as your credit card, to our third party payment processor such as Stripe, which will collect that information and process your payment pursuant to their privacy policy.

What's Private

This data will not be publicly displayed or revealed to other users:

  • any payment information you provide
  • your password details
  • your IP address
  • your phone number
  • communications you send to us (for example, when you ask for support, send us questions or comments, or report a problem)

We don’t give your personal information to any third-party services, except when it’s necessary to provide Apocalypsenow.com Services (like when we partner with payment processors such as Stripe). Except as expressly described elsewhere, such as above with respect to Stripe, when we share data with third-party services that support our delivery of the Apocalypsenow.com Services, we require that they protect your personal information to the same standards we do.

We do reserve the right to disclose personal information when we believe that doing so is reasonably necessary to comply with the law or law enforcement, to prevent fraud or abuse, or to protect Erebus’ legal rights.

What's Public

When you create an account, we create a basic profile page for you on Apocalypsenow.com, containing your account name and the date the account was created. Whenever your account name appears on Apocalypsenow.com (for instance, when you post comments, send messages, or make a pledge), people can click your account name to see your profile. The profile is not searchable on Apocalypsenow.com or via search engines like Google. Here are some of the things that will be publicly viewable on your profile, or elsewhere on Apocalypsenow.com:

  • the account name and the date it was created
  • any information you choose to add to your profile (like a picture, bio, or your location)
  • any comments you’ve posted on Apocalypsenow.com
  • if you have "Liked" or “Shared” a Game update or other content

We will not publicly post your Pledge Tier or Rewards chosen, but we do not restrict you from posting that information about yourself.

Cookies

What they are: Cookies are small data files that are issued to your device when you visit a website and that store information about your use of a service. Pixel tags (which are also called clear GIFs, web beacons, or pixels) are little snippets of code or tiny images embedded on websites and in email that help us learn how you interact with our site and emails.

Uses of Your Personal Information

We will use the personal information you provide to:

  • identify you when you sign in to your account;
  • enable us to provide you with the Services;
  • send you marketing communications we think you may find useful, but only in accordance with your email preferences;
  • provide rewards to you;
  • present rewards opportunities to you when you use the Services which we believe will be of interest based on your geographic location and previous use of the Services;
  • administer your account with us;
  • enable us to contact you regarding any question you make through the Services;
  • analyze the use of the Services and the people visiting to improve our content and Services; and
  • use for other purposes that we may disclose to you when we request your information.

We take securing your data and preserving your privacy very seriously. We never post anything to your Facebook, Twitter, or other third-party accounts without your permission. Your payment information is obfuscated through third-party payment processors. We do not and will not sell your data except as described in this Privacy Policy.

If the equity or assets of Erebus or its owners are acquired by another entity, some or all of our users’ data and other information may be provided to such successor. In such a case, the successor will handle such information in the same manner as provided in this Privacy Policy. Please see our Notice of Changes section below.

Email

We want to communicate with you only if you want to hear from us. We try to keep emails to a minimum and give you the ability to opt out of any marketing communications we send.

We will send you email relating to your personal transactions, including in connection with your rewards. You will also receive certain marketing email communications, in accordance with your preferences, and from which you may opt out at any time.

We may send you service-related announcements on the rare occasions when it is necessary to do so.

Blogs/Forums

The Apocalypsenow.com site may offer publicly accessible blogs and community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. Your ability to remove any of your posts or entries from our blogs or community forums may be limited. In any case, such removal will not affect copies of such posts or entries which may have been viewed or made prior to such removal. So we recommend that you carefully consider any such post or entry prior to submission. In addition, if these forums are hosted by third parties, such as reddit, the privacy policies of such third parties will control with respect to the information you disclose.

Links to Other Sites

The Apocalypsenow.com site and our Services contain links to other sites. We are not responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave the Apocalypsenow.com site and to read the privacy statements of each and every web site that collects information from them. This Privacy Policy applies solely to information collected by the Apocalypsenow.com sites and our Services.

Security

No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee absolute security for the Apocalypsenow.com site or Services.

Erebus takes every precaution to protect our users’ and visitors’ information against loss, misuse and alteration. We use standard industry practices to help prevent unauthorized use of, access to or alteration of visitor and user information. Erebus personnel with access to information gathered from visitors and users have been advised of the importance of maintaining the confidentiality of such information and of using it only for the purposes described in this Privacy Policy.

Choice/Opt-out

Whenever visitors or users submit requests for more information or services from us, they may opt out of entering certain fields. However, such decision may affect the ability to use portions of the Apocalypsenow.com site and the Services. If you receive marketing or similar email messages from us and wish to opt out of receiving such messages, then you may simply follow the opt-out procedure specified in such email. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

Notice of Changes

Erebus may amend this Privacy Policy from time to time. If Erebus is going to use your personal information in a manner different from that stated at the time of collection, we will notify you via email sent to the email address you have provided to us prior to the change becoming effective. You will have a choice as to whether or not we use your personal information in this different manner. In addition, if we make any material changes in our privacy practices, we will post a prominent notice on the Apocalypsenow.com site or in the Services notifying users of the change. In some cases where we post the notice, prior to the change becoming effective we will also email users who have opted to receive communications from us notifying them of such changes in our privacy practices.

Access to Your Information

To modify or delete the personal information you have provided to us, please log in and update your profile. We may retain certain information as required by law or for necessary business purposes.

On request, we will give you a copy of all the personal information about you that we hold. Delivery of this information is subject to a fee not exceeding the prescribed fee permitted by law.

Cross-Border Data Transfers

Information that Erebus collects may be stored and processed in and transferred between any of the countries in which Erebus operates (for example, to our servers in the United States) to enable the use of the information in accordance with this Privacy Policy.

Erebus complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States. Erebus has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. To learn more about the Privacy Shield program, and to view our certification, please visit www.privacyshield.gov.

Erebus is responsible for the processing of personal data it receives, under the Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf. We comply with the Privacy Shield Principles for all onward transfers of personal data from the EU, including the onward transfer liability provisions.

With respect to personal data received or transferred pursuant to the Privacy Shield Framework, we are subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

If you have an unresolved privacy or data use concern that we have not addressed satisfactorily, please contact JAMS, our U.S.-based third party dispute resolution provider (free of charge) at www.jamsadr.com.

Under certain conditions, more fully described on the Privacy Shield website, www.privacyshield.gov, you may invoke binding arbitration when other dispute resolution procedures have been exhausted.
